Supreme Court: DNA swabs allowed upon arrest

The Supreme Court has ruled that law enforcement can take DNA swabs from people arrested and charged with a crime, even before they are convicted.

In a 5-4 decision, the court ruled the state of Maryland was within its rights to take a DNA swab from an arrestee and use it to discover past crimes the arrestee could be guilty of.

The court compared DNA samples to fingerprints or photographs, both of which are taken upon arrest.
